COUNCIL APPROVALS
In Australia, there is no specific nationwide legislation or building code that pertains specifically to tiny houses. The requirements for a tiny house will depend on the state or territory in which you plan to build, as well as the local council’s planning and building regulations.
That being said, in general, tiny houses are usually classified as either a mobile dwelling or a relocatable home, depending on whether or not they are built on wheels or a foundation. If you plan to build a mobile tiny house, you may need to comply with regulations related to roadworthiness, such as weight restrictions and safety requirements. If you plan to build a relocatable tiny house, you may need to comply with regulations related to building standards, such as energy efficiency, fire safety, and disability access.
OUR TINY HOMES ARE COUNCIL-FRIENDLY!
You may not need any council building approvals for your Tiny Home, however, the legislation regarding caravans or portable housing on private property does vary from state to state.
New South Wales legislation allows a caravan to be used as permanent habitation, provided that the occupant is a member of the owner’s household.
In addition, the Local Government regulations in NSW are now allowing caravans to be installed without prior council building approval.
Section 77 of Subdivision 3 in the NSW state legislation relates to Manufactured Home Estates, Caravan Parks, Camping Grounds and Movable Dwellings which are given conditional exemptions where no council building approval is required.
If you are located outside of NSW, check with your local council which should be able to provide the relevant information for your area.
Most councils outside of NSW allow the use of a caravan with a permit, and some even have adopted the same exemption as NSW Legislation.
